The short version: Use Quitopotamus honestly, don't abuse the service, and don't do anything illegal. Subscriptions auto-renew and can be cancelled anytime through your App Store or Google Play account settings. We can terminate accounts that violate these terms.
By downloading, installing, or using the Quitopotamus mobile application or website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms constitute a legally binding agreement between you and Quitopotamus ("we," "our," or "us"). You must be at least 13 years of age (or 16 in the EEA) to use the Service. By using the Service, you represent that you meet this requirement.
Quitopotamus is a habit-tracking application that helps users monitor and reduce bad habits using a weekly win/loss scoring system. The Service allows you to log daily habit data, view weekly and all-time statistics, receive push notification reminders, and track progress over time.
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice.
To use the Service, you must create an account using a valid email address and password. You are responsible for:
You may not create accounts using automated means or under false pretenses. We reserve the right to refuse registration or cancel accounts at our discretion.
Quitopotamus is free to download and use. The free tier allows you to track one habit with full access to all features for that habit.
To track more than one habit, you may purchase a Premium subscription. Premium is available as a monthly or annual subscription and unlocks unlimited habit tracking.
Subscription Terms (Required Disclosure)
Pricing: $4.99 per month, $33.99 per year, or $99.99 once for lifetime access (prices may vary by region and are displayed at the time of purchase).
Billing: Payment will be charged to your Apple ID or Google Play account at confirmation of purchase.
Auto-Renewal: Monthly and annual subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the price confirmed at purchase. The lifetime purchase is a one-time payment with no recurring charges.
Cancellation: You may manage or cancel your subscription at any time through your App Store account settings (iOS: Settings → Apple ID → Subscriptions) or Google Play account settings (Google Play → Account → Payments & subscriptions). Cancellation takes effect at the end of the current billing period — you retain access until then. Lifetime purchases are non-cancellable after purchase.
Refunds: Refunds are handled by Apple or Google in accordance with their respective refund policies. We do not process refunds directly.
Downgrade: If your subscription lapses or is cancelled, your account will revert to the free tier. Habits beyond the first will be archived and remain viewable in your account history, but active tracking will be limited to one habit.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the Service for your personal, non-commercial purposes.

The Service allows you to enter personal content including habit names, descriptions, motivations, and daily log entries ("User Content"). You retain ownership of your User Content.
By entering User Content, you grant us a limited license to store, process, and display that content solely to provide the Service to you. We do not share your User Content with other users or third parties except as described in our Privacy Policy.
You are solely responsible for your User Content. You agree not to enter content that is unlawful, harmful, threatening, abusive, or otherwise objectionable.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
The Service and its original content, features, and functionality — including but not limited to the Quitopotamus name, logo, design, text, and software — are owned by Quitopotamus and are protected by copyright, trademark, and other intellectual property laws.
Nothing in these Terms grants you any right to use our trademarks, logos, or other brand elements without our prior written consent.
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in the Privacy Policy.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE FULLEST EXTENT PERMITTED BY LAW, QUITOPOTAMUS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR ANY OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) $10 USD.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.
You agree to indemnify, defend, and hold harmless Quitopotamus and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Service, your User Content, or your violation of these Terms.
We may suspend or terminate your account and access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.
You may delete your account at any time from the Account tab in the app. Upon deletion, your data will be permanently removed within 30 days as described in our Privacy Policy.
Upon termination, your right to use the Service ceases immediately. Sections 8, 10, 11, 12, 14, and 15 survive termination.
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law principles.
Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.
You agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class action or representative proceeding.
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. For material changes, we will notify you via email or a prominent in-app notice at least 30 days before the change takes effect.
Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.
